Taxation Law

Reliable, informed legal advice on personal and corporate tax.

The tax services team at McKercher has extensive experience advising on both personal and corporate tax matters. Our tax group works closely with members of our other practice groups (corporate, real estate, and litigation) to best address our client’s needs and minimize the impact of taxation on our client’s business.

We regularly advise clients on matters concerning federal income tax, goods and services tax (GST), and Saskatchewan provincial sales tax (PST) matters:

  • Corporate Taxation – Incorporation and organizational matters, corporate internal and divisive reorganizations, purchase and sale of businesses and property, obtaining advance tax rulings, and general corporate tax planning for both private and publically-listed entities
  • Personal Taxation – Estate planning, drafting of tax-efficient wills, creation and use of inter-vivos and testamentary trusts, reorganizations of closely-held corporations, tax planning for professionals such as lawyers, accountants, and doctors, personal tax planning in connection with the sale of a business, and assessment of eligibility of property for the lifetime capital gains exemption
  • Sales Taxes – Application of GST and PST in connection with the sale of a business, assessment of GST and PST implications of land sales, and general transactional structuring to minimize or exempt GST and PST
  • Tax Representation and Litigation – Negotiations with Canada Revenue Agency respecting tax audits and proposals, filing of notices of objection, taxpayer relief applications respecting penalties and interest, access to information requests, filing of notices of appeal to the Tax Court of Canada, and representing clients before the Tax Court of Canada, the Federal Court of Canada, and the Supreme Court of Canada
  • Charities – Assisting clients with applications to register non-profit entities as charities with Canada Revenue Agency
