Saskatoon lawyer, Kit McGuinness discusses recent decisions at both the Saskatchewan’s highest court (Mosaic Potash Esterhazy Limited Partnership v. Unifor Local 892, 2015 SKQB 391)and Canada’s highest court (Stewart v. Elk Valley Coal Corp, 2017 SCC30) relating to the duty to accommodate with regards to addictions in the workplace.  The decisions show how differently courts deal with policies implemented to limit drug and alcohol use in safety-sensitive decisions.
