Janine is a partner in the Saskatoon office where she advises and represents debtors and creditors in restructuring and insolvency proceedings as well as clients in commercial litigation matters.

Janine obtained her Bachelor of Laws in 2002 from the University of Saskatchewan. Prior to this, Janine obtained her Bachelor of Science and Bachelor of Arts in Criminology, Magna Cum Laude, from Florida State University located in Tallahassee, Florida. Janine was admitted to the Saskatchewan Bar in 2003, the Alberta Bar in 2004, and joined McKercher LLP in September 2013. Before joining McKercher LLP, Janine practiced with another major Saskatchewan law firm for seven years. She joined the partnership at McKercher in 2016.

 

Janine advises and represents debtors and creditors in restructuring and insolvency proceedings as well as clients in commercial litigation matters. Her experience includes acting for and against financial institutions in the enforcement of security, foreclosures, receiverships, CCAA proceedings, creditor realizations, plans of arrangement, oppression remedy actions, construction disputes, and injunctions, including Anton Piller and Mareva Injunctions.

 

Janine’s experience in commercial litigation matters spans several industries including construction, energy and natural resources, transportation and franchises.

 

While attending Florida State University, Janine played for the FSU Lady Seminoles Soccer (NCAA Division 1 ACC) on a full athletic scholarship for four years during which time she won numerous personal academic and athletic awards. She was team captain or co-captain while she played during those four years.

 

Janine has appeared before all levels of the Saskatchewan Courts, the Alberta Court of Queen’s Bench, the Alberta Provincial Court and the Supreme Court of Canada.

 

Janine has been recently selected by her peers for inclusion in The Best Lawyers™ in Canada 2024 in the field of Insolvency & Financial Restructuring Law. 2024 is the first year that she has been listed in Best Lawyers®.

 

Janine is also a member of the Law Society of Alberta and is fluent in French.

 

Transactional Experience

 

  • Litigation Counsel for EROS Resources Corp. respecting its merger with Anthem Resources Incorporated by way of plan of arrangement.
  • Assisted as Counsel for Boss Power Corp. respecting the divisive reorganization of that corporation by way of plan of arrangement. The plan of arrangement resulted in certain dissident shareholders of Boss Power Corp. who validly elected, exchanging their common shares of Boss Power Corp. for common shares of Blizzard Finance Corp., a corporation incorporated in order to facilitate the plan of arrangement. The plan of arrangement was the final step in a series of transactions resulting from the negotiated settlement of disputes between Boss Power Corp. and Anthony Beruschi, which transactions allowed for, among other things,  the closing of a $30 million dollar settlement with the Province of British Columbia, and put an end to the debilitating conflict that had gripped Boss Power Corp. for  more than three years.
  • Litigation Counsel for International Road Dynamics Inc., a TSX listed company, respecting the acquisition of all of its issued and outstanding shares by Quarterhill Inc. (formerly Wi-LAN Inc.) pursuant to a plan of arrangement for aggregate consideration of approximately $63.5 million.
