Administrative Law
Our lawyers routinely appear as advocates before various administrative and governmental tribunals on matters such as professional regulation, human rights, labour and employment disputes, commercial arbitration, and municipal tax re-assessment. We also have experience acting as counsel for administrative tribunals. In addition, we have litigation lawyers who specialize in assisting clients to apply for judicial review of administrative decisions and actions
Alternative Dispute Resolution
McKercher lawyers are skilled at engaging in dispute resolution processes and negotiative techniques that provide a means for parties who are in conflict to resolve their issues short of litigation. We regularly pursue negotiation, mediation, collaborative law and arbitration on our clients' behalf.
Arbitration
Our lawyers are skilled at guiding clients through the Arbitration process, whereby a third party issues a decision that is binding on all parties. Arbitration may offer faster and less adversarial results than protracted litigation. We will identify and enlist quality arbitrators and mediators, advocate on our clients' behalf in such proceedings, and offer advice in the review and appeal of arbitral awards.
Class Actions and Mass Torts
McKercher LLP has a wealth of expertise in respect to complex commercial multi-party litigation, both at the trial and appellate levels. The Firm participated as counsel in a number of complex tort class proceeding. In addition, we have also acted as both plaintiff and defence counsel in regard to many representative actions brought in Saskatchewan.
Corporate and Commercial Litigation
McKercher LLP regularly represents clients in a wide range of business disputes, including disputes involving shareholder rights, director and officer liability, securities laws, commercial leases and contracts, franchising issues, financing and lending, trust and fiduciary issues, construction issues, and real property. Our commercial litigators are also experienced in various alternate dispute resolution processes. We work with our clients to develop dispute resolution strategies to minimize the business disturbance caused by the commercial dispute.
Insurance Law
Members of this practice group are involved in all areas of insurance litigation, including property, disability and professional liability claims. Professional liability litigation has become a significant part of the Firm’s insurance portfolio, with members of this practice group acting as counsel for several professional bodies in the Province. The Firm has also developed expertise in construction litigation, acting on behalf of owners, contractors, suppliers and construction professionals.

Medical Malpractice Defense
